The Constitution (Distribution of Revenues) No. 9, 2007.

1THE CONSTITUTION (DISTRIBUTION OF REVENUES) NO. 9, 2007

In exercise of the powers conferred by clause (2) of article 275 of the Constitution, the President, after having considered the recommendations of the Finance Commissions, hereby makes the following Order, namely :--

1. This Order may be called the Constitution (Distribution of Revenues) No. 9 Order, 2007.

2. The General Clauses Act, 1897 (10 of 1897), shall apple for the interpretation of this Order as it applies for the interpretation of a Central Act.

3 (1) In accordance with the provisions of clause (1) of article 275, there shall be charged on the Consolidated Fund of India, in the financial year commencing on the 1st day of April, 2006, as grants-in-aid of the revenues to each of the Slates specified in column (1) of the Table below, the sums specified against it in each of the column (2) of the said Table, namely:--

(2) The sums specified in column (2) the Table in sub-paragraph (1) represent the amount recommended by the Twelfth Finance Commission for the year 2006-07

(3) The Eleventh finance Commission in its report on the additional terms of reference had recommended withholding of 15 per cent of the non-plan revenue deficit grant recommended to the States with matching contribution by the Central Government for crediting into an Incentive Fund from which fiscal performance based grants were required to be released to all the Stales During the year Rs. 96.92 crore was released to State of Tamil Nadu from the Incentive Fund based on the fiscal performance of State during 2004-05 as Centres contribution to the Incentive Fund.

(4) Any sum or sums payable under sub-paragraph (1) shall be in addition to any sum or sums payable to the Stales under each of the provisos to clause ( 1) of article 275.
