Constitution (Distribution of Revenues) Order, 1984.

1 THE CONSTITUTION (DISTRIBUTIONOF REVENUES)ORDER, 1984

Inexercise of the powers conferred by article 275of the Constitution, the President, after having considered the recommendationsof the Finance Commission, hereby makes the followingOrder, namely:--

1.This Order may be called the Constitution (Distribution ofRevenues) Order, 1984.

2.The General Clauses Act, 1897 (10of 1897), shall apply for the interpretation of this Order as it applies "for the interpretation of aCentral Act.

3.(1)In accordance with the provisions of clause (1) of article 275,there shall be charged on the Consolidated Fund of India, inthe financial year commencing on the 1 st day of April, 1983,as grants-in-aid of the revenues of--

(a)each of the States specified in column (1) of the Table below, thesums specified against it in each of the columns (2)to (6)of the said Table, towards expenditure, of revenue and capital nature, onprogrammes for upgradation of standards relating to the administration of thesectors and services mentioned in those columns:--

Providedthat the sums specified above shallbe expended on programmes formulated by the State Governments for upgrading thestandards relating to the administration of the sectors and services specifiedabove and approved by the Central Government:

Providedfurther that if the actual expenditure on such approved programme or programmesrelating to any administration, as revealed in the accounts of that year, islower than the amount of grant specified above against that administration, theamount so paid in excess shallbe adjusted against any sum or sums which may become payable to that State inany of the succeeding years for the same purpose or any other purpose;

(b)each of the States specified incolumn (1) of the Table below, the sums specified against itin column (2) of the Table, towards net interest liability onaccount of fresh borrowings and tendings of each of those States, in thefinancial years commencing on the 1st day of April, 1979,1980, 1981, 1982and 1983after taking into account the grants paid towards net interest liability underthe Constitution (Distribution of Revenues) Order, 1981,the Constitution (Distribution of Revenues) Order, 1982and the Constitution (Distribution of Revenues) Order, 1983as per the recommendations of the Finance Commission in this regard:--

Providedthat if the figures of actual borrowings and lendings as revealed in theaccounts of those years, or the rates of interest on borrowings are differentfrom the relevant figures taken into account in determining the grants specifiedabove, the amount of grant so paid shallbe adjusted against any sum or sums which may become payable to that State inany of the succeeding years for the same purpose or any other purpose.

(2)Any sum or sums payable under clauses (a)and (b) of sub-paragraph (1) to any State, in thefinancial year commencing on the 1st day of April, 1983shall be in addition to the sum orsums payable to that State in that financial year in pursuance of sub-paragraph (1) of paragraph4of the Constitution (Distribution of Revenues) Order, 1979.
