Constitution (Distribution of Revenues) Order, 1991.

1 THECONSTITUTION (DISTRIBUTIONOF REVENUES)ORDER, 1991

Inexercise of the powers conferred by article 275of the Constitution, the President, after having considered the recommendationsof the Finance Commission, hereby makes the followingOrder,namely:--

1.ThisOrder may becalled the Constitution (Distribution of Revenues)Order, 1991.

2.The General Clauses Act, 1897(10of 1897),shall apply forthe interpretation of thisOrder as itapplies for the interpretation of a Central Act.

3.(1)In accordance with the provisions of clause (1)of article 275,thereshall becharged on the Consolidated Fund of India, in the financial year commencing onthe 1stday of April, 1990,as grants-in-aid of the revenues of--

(a)each of the States specified in column (1)of the Table below, the sums specified against it in each of the columns (2)to (11)of the said Table, towards expenditure of revenue and capital nature onprogrammes for upgradation of standards and "Special Problems"relating to the administration of the sectors and servicesmentioned inthese columns:--

Providedthat the sums specified aboveshall beexpended on programmes formulated by the State Governments for upgrading thestandards relating to the administration of the sectors and services specifiedabove and approved by the Central Government:

Providedfurther that the amount of grant specified above against any administration issubject toadjustment within the financial year commencing on the 1stday of April, 1991against the actual expenditure incurred on approved programme or programmesrelating to such administration, as revealed in the accounts of that year;

(b)each of the States specified in column (1)of the Table below, the sums specified against it in each of the columns (2)to (11)of the said Table, towards expenditure of revenue and capital nature, onprogrammes approved by the Central Government for upgradation of standards and"Special Problems"mentioned inthose columns, incurred in the financial year commencing on the 1stday of April, 1990:--

Providedthat if the actual expenditure on such approved programme or programmes relatingto any administration as revealed in the accounts of that year is lower than theamount of grant specified above against that administration, the amount so paidin excessshall beadjusted against any sum or sums which may become payable to that State in anyof the succeeding years or anyother purpose.

(2)Any sum or sums payable under clauses (a)and (A) ofsub-paragraph (1)to any State in the financial year commencing on the 1stday of April, 1990shall bein addition to the sum or sums payable to that State in that financial year inpursuance ofsub-paragraph (1)of paragraph 4of the Constitution (Distribution of Revenues)No. 3Order, 1990.
