Constitution (Distribution of Revenues) No. 2 Order, 1989.

1 THE CONSTITUTION (DISTRIBUTION OF REVENUES)NO. 2 ORDER, 1989

In exercise of the powers conferred by article 275of the Constitution, the President, after having considered the recommendationsof the Finance Commission, hereby makes the following Order,namely:--

1. This Ordermay be called the Constitution (Distribution of Revenues) No. 2Order, 1989.

2.The GeneralClauses Act, 1897(10of 1897),shall apply forthe interpretation of this Order as it applies for the interpretation of a CentralAct.

3.(1) Inaccordance with the provisions of clause (1) of article 275,there shall becharged on the Consolidated Fund of India, in the financial year commencing onthe 1stday of April, 1988,as grants-in-aid of the revenues of each of the States specified below, the sumsspecified against it as representing the share of the Central Government of the margin moneytowards affording relief in connection with natural calamities in the States:--

Provided that the sums specified aboveshall beexpended in the financial year commencing on the Ist day of April, 1988,on measuresfor affording relief in connection with natural calamities in the States:

Provided further that if the actual expenditure onrelief measuresas revealed in the accounts of that year, is lower than the sums specifiedabove, the balanceshall be carriedforward to the next year and utilised for the same purpose.

(2) Anysum or sums payable under sub-paragraph (1) to any State, in the financial year commencing on the1stday of April, 1988,shall be inaddition to the sum or sums payable to that State in that financial year inpursuance of sub-paragraph (1) ofparagraph 4of the Constitution (Distribution of Revenues) Order, 1985.
