The Constitution (Distribution of Revenues) No. 2 Order, 1999.

1 THECONSTITUTION (DISTRIBUTIONOF REVENUES) No.2 ORDER,1999

Inexercise of the powers conferred by article 275of the Constitution, the President after having considered the recommendationsof the Finance Commission, hereby makes the followingOrder, namely:--

1.ThisOrder may be called theConstitution (Distribution of Revenues)No. 2Order, 1999.

2.The General Clauses Act, 1897(10of 1897),shall apply for theinterpretation of thisOrder as it applies for theinterpretation of a Central Act.

3.(1)In accordance with the provisions of clause (1)of article 275,thereshall be charged on theConsolidated Fund of India, in the financial year commencing on the 1stday of April, 1998,as grants-in-aid of the revenues of--

(a)each of the States specified in column (1)of the Table below, the sums specified against it in column (2)of the said Table towards grants for Panchayati Raj Institutions:--

Providedthat the sums specified aboveshall be paid to the PanchayatiRaj Institutions in the said financial year by a State Government and these sumsshall be in addition to the sumsflowing to the Panchayati Raj Institutions from the State Government:

Providedfurther that the sums specified aboveshall be expended by PanchayatiRaj Institutions as per the recommendations of the Tenth Finance Commissioncontained in Chapter X of its report and in the revised guidelines issued by theCentral Government for utilisation of the grants from that Government to theState Governments in this regard;

(b)each of the States specified in column (1)of the Table below, the sums specified against it in column (2)of the said table towards grants for Urban Local Bodies:--

Providedthat the sums specified aboveshall be paid to the Urban Local Bodiesin the said financial year by a State Government and these sumsshall be in addition to the sums flowing to the Urban Local Bodiesfrom the State Government;

Providedfurther that the sums specified aboveshall be expended by Urban LocalBodiesin terms of the recommendations of the Tenth Finance Commission as contained inChapter X of its report and in the revised guidelines issued by the CentralGovernment for utilisation of the grants from that Government to the StateGovernments in this regard.

(2)Any sum or sums payable undersub-paragraph (1)shall be in addition to any sumor sums payable to the States under each of the provisos to clause (1)of article 275.
