Section 59 - Conduct of Business of Provincial Government in Government of India Act, 1935 [Repealed]

Conduct of Business of Provincial Government.

(1) All executive action of the Government of a Province shall be expressed to be taken in the name of the Governor.

(2) Orders and other instruments made and executed in the name of;the Governor shall be authenticated in such manner as may be specified inrules to be made by the Governor, and the validity of an order or instrumentwhich is so authenticated shall not be called in question on the ground that;it is not an order or instrument made or executed by the Governor.

(3) The Governor shall make rules for the more convenient transaction of the business of the Provincial Government, and for the allocation among ministers of the said, business [in so far as it is not business with respects to which the Governor is by or under this Act required to act in his discretion.]

1(4) The rules shall include-provisions requiring ministers and secretaries to Government to transmit to the Governor all such informationwith respect to the business of the Provincial Government as may be specifiedin the rules, or as the Governor may otherwise require to be so transmitted,and in particular requiring a minister to bring to the notice of the Governor,and the appropriate secretary to bring to the notice of the minister concernedand of the Governor, any matter under consideration by him which involves,or appears to him likely to involve, any special responsibility of theGovernor.

1(5) In the discharge of his functions under sub-section (2), (3) and(4) of this section the Governor shall act in his discretion after consultationwith his ministers.
