Control of Federation over Province in Certain Cases.

(1) The executive authority of every Province shall be so exercised as not to impede or prejudice the exercise of the executive authority of the1[Federation], and the executive authority of the1[Federation] shad extend to the giving of such directions to a Province as may appear to the1[Federal] Government to be necessary for that purpose.

(2) The executive authority of the1[Federation] shall also extend to the giving of directions to a Province as to the carrying into execution therein of any Act of the1[Federal] Legislature which relates to a matter specified in Part II of the Concurrent Legislative List and authorises the giving of such directions:

Provided that a Bill or amendment which proposes to authorise the giving of any such directions as aforesaid shall not be introduced into or moved in either Chamber of the1[Federal] Legislature with the previous sanction of the Governor-General in his discretion.

(5) The executive authority of the1[Federation] shall also extend to the giving of directions to a Province as to the construction and maintenance of means of communication declared in the direction to be of military importance:

Provided that nothing in this sub-section shall be taken as restricting the power of the Federation to construct and maintain means of communication as part of its functions with respect to naval, military and air force works.

2[(4) If it appears to the Governor-General that in any Province effecthas not been given to any directions given under this section, the Governor-General, acting in his discretion, may issue as orders to the Governor of that Province either the directions previously given or those directions modifiedin such manner as the Governor-General thinks proper].

3[(5) Without prejudice to his powers under the last preceding sub-section, the Governor-General, acting in his discretion, may at any time issue orders to the Governor of a Province as to the manner in which the executive authority thereof is to be exercised for the purpose of preventing any grave menance to the peace or tranquillity of India or of any part thereof].
