Law Declared by Federal Court and Privy Council to Be Binding on Courts.

The law decided by Federal Court and by any judgment of thePrivy Council shall, so far as applicable, be recognised as binding on and shall be followed by allcourts in1[British India], and, so far as respects theapplication and interpretation of this Act or any Order in Council2[thereunder] or any matter with respect to which theFederal Legislature has power to make laws in relation to the State, in anyFederated State.

1.Substituted, in the India (Federal Court Judges) Act, 1942 (5 & 6 Geo. 6, Ch. 7)S. 1., by the words--

"any Governor's Province or Chief Commissioner's Province".

2.Substituted, by the India (Federal Court Judges) Act, 1942 (5 & 6 Geo. 6, Ch. 7)S. 1., by the words--

"or order thereunder, or of the Indian Independence Act, 1947, or of anyorder thereunder".
