A no to Same Sex Marriage

The Constitution Bench ruled that there is no fundamental right to marry, and the court cannot enter judicial legislation to read gender-neutral provisions into the Special Marriage Act. It was left to Parliament to undertake the process of legal recognition of same-sex unions.
